Basement Egress Windows: Toronto Fire Code Requirements Explained

- The Law: Any bedroom in a basement MUST have an egress window.
- The Magic Number: 3.8 sq. ft. (0.35 m²) of unobstructed clear opening.
- Minimum Dimension: No dimension can be less than 15 inches (380mm).
- The Well: If you dig down, the well must stick out 30 inches (760mm) from the wall.
Answer First: To be legal in Ontario/Toronto, a basement bedroom window must open to provide a clear space of at least 3.8 square feet. It must also be easy to open without tools or special knowledge. Note: Sliding windows often fail this test unless they are huge.
Why Egress Matters (Beyond Safety)
Yes, you need it so you don't die in a fire. But you also need it for Property Value.
- Legal Bedroom: Without an egress window, you cannot list a basement room as a "Bedroom" on MLS. It’s just "Storage" or "Den".
- Rental Income: Legal basement apartments require egress verification for fire inspection certificates.
The Dimensions: It's Not Size of Glass, It's Size of Hole
This is the #1 mistake DIyers make. They buy a window that is 3.8 sq ft total size. WRONG. It is the Clear Opening—the actual hole you crawl through when the window is open.
- Slider Pattern: Only half the window opens. To get 3.8 sq ft of opening, the window needs to be massive (approx 60" x 30").
- Casement Pattern: The sash swings out completely. A much smaller window (approx 24" x 36") can meet the code.
- Tilt & Turn: The gold standard for egress. Swings in like a door.
The Math Check
- Open the window fully.
- Measure the width of the open space.
- Measure the height of the open space.
- Multiply Width x Height (in inches) and divide by 144.
- Is it > 3.8? Pass.
The Window Well Trap
Cutting the concrete foundation ("Concrete Cutting") is only half the battle. If you are deep underground, you need a Window Well.
Ontario Building Code (9.9.10.1):
- The well must provide at least 760mm (approx 30 inches) of clearance in front of the window.
- If the well is deeper than 600mm (24 inches), it shouldn't impede the swing of the window (use sliders or inswing tilt-turns).
Structural Implications
Enlarging a basement window means cutting into your foundation wall.
- Lintels: You usually need to install a steel angle iron (lintel) to support the bricks/joists above the new wider hole.
- Weeping Tile: Digging down requires connecting the window well drain to your weeping tile system. Otherwise, you are just building an aquarium that will flood your basement.
